These Terms of Service (“Terms”) govern your access to and use of precisionspeptides.com (collectively, the “Site”), operated by PrecisionsPeptides.com (“PrecisionsPeptides.com,” “we,” “us,” or “our”), and your purchase of any products offered through the Site. Please read these Terms carefully. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, Shipping Policy, and Refund Policy, each incorporated by reference. If you do not agree, do not use the Site.

1. Research Use Only; Important Acknowledgment

All products offered through the Site are sold and intended solely for laboratory research and development use only (“Research Use Only” or “RUO”). By accessing the Site or purchasing any product, you acknowledge, understand, and agree that:

  • The products are not for human or animal consumption and are not to be used in or on the body of any human or animal for any purpose.
  • The products are not drugs, foods, dietary supplements, cosmetics, or medical devices, and are not intended for clinical, diagnostic, therapeutic, or other use in the diagnosis, cure, mitigation, treatment, or prevention of any disease or condition.
  • The products have not been approved by the U.S. Food and Drug Administration (FDA), and the statements made on the Site have not been evaluated by the FDA.
  • No information on the Site constitutes medical advice, and nothing on the Site should be construed as guidance for the human or animal use of any product.
  • PrecisionsPeptides.com is a chemical supplier and is not a compounding pharmacy or chemical compounding facility as defined under Section 503A of the Federal Food, Drug, and Cosmetic Act, and is not an outsourcing facility as defined under Section 503B of the same Act.

By placing an order, you represent and warrant that you are acquiring the products for legitimate research or development purposes only; that you are a qualified researcher, or are acting on behalf of a qualified research or business entity, with the knowledge and facilities to handle the products safely and lawfully; and that you will not use, resell, distribute, repackage, or supply the products for human or animal consumption or for any unlawful purpose.

2. Eligibility and Accounts

You must be at least 18 years of age (or the age of majority in your jurisdiction, if higher) and able to form a binding contract to use the Site or place an order. The Site is intended for users located in the United States; we do not ship products internationally.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to keep it updated. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are associated with prohibited use.

3. Acceptable Use and Prohibited Conduct

  • Use the Site or any product in violation of any applicable federal, state, or local law or regulation;
  • Misrepresent the research-use-only nature of the products, or remove, alter, or obscure any product labeling, lot/batch information, or warnings;
  • Access the Site through automated means, scrape data, introduce malware, attempt to gain unauthorized access, or interfere with the Site’s operation or security;
  • Use the Site to infringe the intellectual property or other rights of any party, or to transmit unlawful, harmful, or fraudulent content.

We reserve the right to refuse service, cancel orders, and restrict or terminate access at our discretion, including where we reasonably believe a product may be intended for prohibited use.

4. Handling, Safety, and Regulatory Compliance

You are solely responsible for the safe and lawful receipt, handling, storage, use, and disposal of all products, including compliance with all applicable laws, regulations, institutional policies, and good laboratory practices. Products may be hazardous and should be handled only by qualified personnel trained in laboratory safety, using appropriate protective equipment and consistent with any applicable safety data sheet (SDS). You assume all risk and liability arising from your receipt, possession, handling, use, and disposal of the products.

5. Products, Pricing, and Availability

We strive to describe products accurately, but we do not warrant that product descriptions, images, pricing, or other content on the Site are complete, accurate, current, or error-free. Products are subject to availability, and we may modify, discontinue, or limit the quantity of any product at any time without notice. Prices are stated in U.S. dollars and are subject to change. In the event of a pricing or descriptive error, we reserve the right to cancel or refuse any order placed for the affected product, even after an order has been submitted or confirmed.

6. Orders, Acceptance, and Payment

Your submission of an order is an offer to purchase. All orders are subject to our acceptance, and we may accept or decline an order, in whole or in part, for any lawful reason. A confirmation email acknowledges receipt of your order but does not constitute acceptance. You authorize us and our payment processors to charge your selected payment method for the total order amount, including applicable taxes and shipping. You represent that you are authorized to use the payment method provided. We reserve the right to cancel orders that we suspect are fraudulent, unauthorized, or in violation of these Terms.

7. Shipping, Title, and Risk of Loss

Shipping terms, methods, and timeframes are described in our Shipping Policy. Unless otherwise stated, title and risk of loss for products pass to you upon our delivery of the products to the carrier. We are not responsible for carrier delays or for events outside our reasonable control.

8. Returns and Refunds

Returns, cancellations, and refunds are governed by our Refund Policy. Due to the nature of the products, certain items may be non-returnable except where required by law or where a product is defective or incorrect, as described in the Refund Policy.

9. Third-Party Brands and Products

The Site offers products from a range of brands and manufacturers. Brand names, trademarks, and logos are the property of their respective owners, and their appearance on the Site does not imply endorsement or affiliation beyond the supply relationship. To the extent any product is manufactured or supplied by a third party, any manufacturer warranties (if any) are the responsibility of that manufacturer, and our liability is limited as set forth in these Terms.

10. User Content

If you submit reviews, comments, or other content to the Site (“User Content”), you grant PrecisionsPeptides.com a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that User Content in connection with the Site and our business. You represent that you own or have the necessary rights to your User Content and that it does not violate any law or third-party right. We may remove User Content at our discretion. User Content must not include claims regarding human or animal use, dosing, or therapeutic effects of any product.

11. Intellectual Property

The Site and its content—including text, graphics, logos, images, and software—are owned by or licensed to PrecisionsPeptides.com and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purpose. You may not copy, reproduce, distribute, modify, or create derivative works from the Site or its content without our prior written consent.

12. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, PRECISIONSPRECISIONSPEPTIDES.COM DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, PRECISIONSPRECISIONSPEPTIDES.COM MAKES NO WARRANTY THAT ANY PRODUCT IS SUITABLE FOR ANY PARTICULAR RESEARCH APPLICATION, AND MAKES NO WARRANTY OR REPRESENTATION REGARDING ANY USE OF THE PRODUCTS IN OR ON HUMANS OR ANIMALS, WHICH USE IS STRICTLY PROHIBITED.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PRECISIONSPRECISIONSPEPTIDES.COM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, SUPPLIERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless PrecisionsPeptides.com and its officers, directors, employees, suppliers, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site or any product; (b) any use of any product in or on humans or animals, or for any consumption or therapeutic purpose; (c) your violation of these Terms or any applicable law or regulation; or (d) your violation of any third-party right. This indemnification obligation survives termination of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and, where appropriate, provide additional notice. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

16. General

These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and PrecisionsPeptides.com regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our consent; we may assign them freely. We are not liable for any failure or delay in performance due to causes beyond our reasonable control.
